When you purchase the eBook, you can use the PDN System all you want to make your own prints and sell as many of them as you want. The price of purchasing the eBook includes a lifetime license to do this.

PLease do not make copies of all or parts of the eBook, Spreadsheet, or Calibration Palettes and distribute them or make them available to other folks.

PRECISION DIGITAL NEGATIVES LICENSING & COPYRIGHT INFORMATION

  1. Copyright Information
    1. All materials included in Precision Digital Negatives for Silver and Other Alternative Photographic Processes, including text, illustrations, images, software, graphic files, and calibration palettes (hereafter referred to as PDN SYSTEM) are copyrighted by Mark I. Nelson, 2004, unless otherwise indicated.
    2. The PDN SYSTEM is protected by copyright laws, international treaties, intellectual property laws and international intellectual property treaties.
    3. The PDN SYSTEM is available for use to the original purchaser of the book on a restricted basis and may not be reproduced either whole or in part by any physical or electronic means and transferred to any third party.
    4. The PDN SYSTEM and the Individual License are non-transferable to any third party.
    5. Retail distribution of the CD-ROM containing the PDN SYSTEM is limited to only those parties directly authorized by Mark I. Nelson. The CD-ROM containing the PDN SYSTEM may not be discounted by any authorized retailer below the retail price of $75, including offering the electronic book bundled with any other discounted item.

  2. License Information
    1. The PDN SYSTEM is licensed not sold.
    2. The PDN SYSTEM Website Access is limited to registered users of the PDN SYSTEM only. Sharing of password access to the website with third parties is grounds for revocation of Website Access, revocation of License, and civil court action.
    3. The software may not be reverse engineered or components transferred to any other application
    4. The PDN SYSTEM may not be loaned or rented in whole or in part to any other individual or entity
    5. End-user License Agreement Classifications
      1. Individual License
        1. A purchaser of the CD-ROM containing the PDN SYTEM is granted an Individual License upon registration with Precision Digital Negatives. Registration may be done by email to Mark I.         2. The Individual License allows the grantee use of the PDN SYSTEM for the purpose of Calibration and the creation of digital negatives for contact printing and the making of prints from these negatives of only original works of the grantee. The grantee may sell these works freely.
        3. The user agrees not to remove any copyright notices, logos or website information from any palettes, software, or book text.
        4. All persons granted Individual Licenses will be granted access to areas of the website reserved for registered users.
        5. Individual Licenses and access to areas of the website reserved for registered users may be revoked for failure to comply to this agreement. Grantees agree to destroy all copies of the PDN System, including the original, and agree to refrain from further use of the process. See section on Litigation.
      2. Print-For-Pay License & Certification
        1. A Print-For-Pay License is required for all individuals or companies who wish to use the PDN SYSTEM for the production of both negatives for contact printing and prints for third parties.
        2. The grantee agrees not to remove any copyright notices, logos or website information from any palettes, software, or book text.
        3. A Print-For-Pay License must be applied for. Inquiries regarding obtaining a Print-For-Pay License are to be sent to Mark I. Nelson at This e-mail address is being protected from spam bots, you need JavaScript enabled to view it unless otherwise notified.
        4. A Print-For-Pay License requires certification.
        5. All individuals or companies granted Print-For-Pay Licenses will be listed on the URL/website: www.precisiondigitalnegatives.com unless otherwise notified.
        6. All individuals or companies granted Print-For-Pay Licenses will be granted access to areas of the website reserved for registered users.
        7. Print-For-Pay Licenses and access to areas of the website reserved for registered users may be revoked for failure to comply to this agreement and the terms of the Print-For-Pay License. If revocation occurs, Grantees agree to destroy all copies of the PDN System, including the original, and agree to refrain from further use of the process. See section on Litigation.
      3. Educational License & Certification
        1. An Educational License is required for all teachers working in certified educational institutions who wish to use the PDN SYSTEM in the classroom for the production of both negatives for contact printing and prints or who wish to use the PDN SYSTEM in whole or in part to teach the production of digital negatives for contact printing and prints from the negatives.
        2. All students enrolled in such a class are required to purchase a copy of Precision Digital Negatives for Silver and Other Alternative Photographic Processes.
        3. All teachers with Educational Licenses agree to verify that students have purchased and registered their copy of the PDN SYSTEM.
        4. Educational discounts will be made available to students enrolled in a class with a certified instructor with an Educational License.
        5. An Educational License requires Certification. Certification is done on an individual basis.
        6. The grantee agrees not to remove any copyright notices, logos or website information from any palettes, software, or book text.
        7. All individuals teaching in educational institutions granted Educational Licenses and the educational institution will be listed on the URL/website: www.precisiondigitalnegatives.com unless otherwise notified.
        8. Educational Licenses and access to areas of the website reserved for registered users may be revoked for failure to comply with this agreement and the terms of the Educational License. If revocation occurs, Grantees agree to destroy all copies of the PDN System, including the original, and agree to refrain from further use of the process. See section on Litigation.
      4. Workshop License & Certification
        1. A Workshop License is required for all individuals who wish to use the PDN SYSTEM in a workshop for the production of both negatives for contact printing and prints or who wish to use the PDN SYSTEM in whole or in part to teach the production of digital negatives for contact printing and prints from the negatives.
        2. All students enrolled in such a workshop are required to purchase a copy of Precision Digital Negatives for Silver and Other Alternative Photographic Processes.
        3. All Workshop Instructors with Workshop Licenses agree to verify that students have purchased and registered their copy of the PDN SYSTEM.
        4. A Workshop License requires Certification.
        5. The grantee agrees not to remove any copyright notices, logos or website information from any palettes, software, or book text.
        6. All individuals granted Workshop Licenses will be listed on the URL/website: www.precisiondigitalnegatives.com unless otherwise notified.
        7. Workshop Licenses and access to areas of the website reserved for registered users may be revoked for failure to comply with this agreement and the terms of the Workshop License. If revocation occurs, Grantees agree to destroy all copies of the PDN System, including the original, and agree to refrain from further use of the process. See section on Litigation.
      5. License for Other Commercial Uses

  3. Patent Information
    1. a. The Color Density Range Control process and its related uses and palettes are patent pending and covered by the Patent Laws of the United States and related Patent Treaties.
  4. Litigation
    1. All litigation related to Copyright, License, and Patent infringements and violations in the United States will be filed in the State of Illinois, County of Kane, subject to the laws of the State of Illinois. Federal litigation will take place in the Northern District of Illinois. Defendants will be responsible for all filing fees, court costs, attorney fees and any other costs related to litigation.
    2. Failure to comply with any parts of this agreement will be cause for the termination of the agreement.
